California Health and Safety Code section 11352 covers specified acts involving sale, furnishing, administration, giving away, transportation for sale, and importation. Transportation alone isn’t automatically transportation for sale. Likewise, the presence of a controlled substance doesn’t establish possession for sale by itself. Prosecutors must prove every element of the charged offense beyond a reasonable doubt, not simply rely on a trafficking label.

Prosecutors may use direct evidence or ask the court or jury to infer intent from the surrounding circumstances, such as packaging, communications, or money. The strength of those inferences depends on the full context.
