When an Entry Can Lead to a California Burglary Charge

California Penal Code section 459 defines burglary as entering a place covered by the statute with the intent to commit theft or another felony. That intent must exist at the time of entry, so the offense can be complete even if the intended crime is never carried out.

Forced entry isn’t required. An allegation may follow entry through an unlocked door or access gained without property damage. Because intent is central to the charge, statements, conduct, and surrounding evidence may become important.

First- & Second-Degree Burglary

Burglary of an inhabited dwelling or another listed inhabited structure falls within the first degree and is treated as a felony. An inhabited dwelling is a residence currently used for dwelling purposes, including when its occupants are temporarily absent.

Burglary involving a place outside that residential category falls within the second degree. Depending on the allegations, evidence, and circumstances, prosecutors may file it as either a misdemeanor or felony.

How Shoplifting Differs from Burglary

Shoplifting under section 459.5 is a distinct offense. It concerns entering an open commercial establishment during regular business hours with the intent to steal merchandise worth $950 or less. The timing, location, intended offense, and property value can affect how prosecutors characterize the conduct.

Our theft-related representation also includes:

  • Petty theft
  • Grand theft
  • Auto theft
  • Shoplifting
  • Residential burglary
  • Robbery
  • Receiving stolen property
  • Embezzlement

How a Burglary Charge Can Affect Sentencing

The possible consequences depend heavily on the degree of the charge and whether a second-degree allegation is filed as a misdemeanor or felony. Under Penal Code section 461, burglary in the first degree carries a state-prison term of two, four, or six years.

A misdemeanor conviction in the second degree carries up to one year in county jail. When prosecutors file the charge as a felony without another specified term, section 1170(h)(1) provides possible county-jail terms of 16 months, two years, or three years.

Burglary of an inhabited dwelling also counts as a strike under California’s Three Strikes law, which can increase the consequences of a later felony conviction. Exposure in an individual case depends on the filed charge, alleged facts, criminal history, and other applicable sentencing rules.

Defense Issues We Examine in Burglary Cases

Burglary defense in Mammoth Lakes centers on the elements prosecutors must establish, particularly what the accused person intended upon entering. We evaluate the evidence rather than assuming that entry and a later event establish the required intent.

Issues we assess can include:

  • Lack of criminal intent: The evidence may not establish an intent to commit theft or another felony at the moment of entry.
  • Misidentification: A witness, image, or other identification may connect the wrong person to the alleged conduct.
  • Unlawful search and seizure: Police collection of physical or digital evidence may raise questions under constitutional search-and-seizure protections.

These aren’t automatic defenses, and their relevance depends on the available evidence. Our attorneys examine the events leading to the accusation, the identification process, and how law enforcement obtained evidence prosecutors intend to use.

How Burglary Proceedings Unfold in Mono County

A criminal case may begin with an investigation, an arrest, or the filing of a charge. We handle burglary cases at each stage, including arraignment, a preliminary hearing, and later court proceedings.

Criminal cases arising in the southern part of Mono County are heard at the Mammoth Lakes Courthouse. Most in-custody criminal cases are handled at a separate Mono County court, so the location and next appearance can depend on custody status and case assignment.

What Happens After Arraignment

At arraignment, the court states the charge and receives a plea. After a not-guilty plea in a Mono County felony case, the case generally moves toward the next evidentiary stage unless it’s resolved or the procedure changes for another legally recognized reason.

At this stage, the district attorney presents evidence supporting the accusation that the defendant committed the felony. The judge doesn’t determine guilt beyond a reasonable doubt, but instead decides whether sufficient evidence exists for the case to continue.

If the judge finds sufficient evidence, the defendant is held to answer and arraigned again in superior court. The progression and timing can vary with the charges, custody status, evidence, and court scheduling.
